I augusti 2024 publicerades den nya AI-f\u00f6rordningen (AI Act) i kraft, vilket inneb\u00e4r nya krav f\u00f6r f\u00f6retag som anv\u00e4nder AI inom EU. F\u00f6rordningens syfte \u00e4r att s\u00e4kerst\u00e4lla en ansvarsfull AI-utveckling och skydda allm\u00e4nhetens r\u00e4ttigheter.<\/span><\/p>\n

M\u00e5let \u00e4r att <\/span>skapa ett s\u00e4kert AI-ekosystem i EU.<\/b><\/p>\n

Fr\u00e5gan \u00e4r vad detta inneb\u00e4r f\u00f6r f\u00f6retag och vilka \u00e5tg\u00e4rder som kr\u00e4vs f\u00f6r att s\u00e4kerst\u00e4lla efterlevnad av de nya reglerna.<\/span><\/p>\n

Vilka f\u00f6retag omfattas av AI Act?<\/b><\/h2>\n

AI Act p\u00e5verkar f\u00f6retag som utvecklar, s\u00e4ljer eller anv\u00e4nder AI-system inom EU, oavsett storlek. \u00c4ven f\u00f6retag utanf\u00f6r EU som erbjuder AI-tj\u00e4nster till EU-marknaden omfattas. De akt\u00f6rer som fr\u00e4mst p\u00e5verkas \u00e4r:<\/span><\/p>\n

  • Utvecklare och leverant\u00f6rer av AI-system<\/b> som s\u00e4ljer eller skapar AI-l\u00f6sningar, s\u00e4rskilt h\u00f6grisk-AI.<\/span><\/li>\n
  • Distribut\u00f6rer och \u00e5terf\u00f6rs\u00e4ljare<\/b> av AI-l\u00f6sningar inom EU, \u00e4ven om de inte utvecklar sj\u00e4lva tekniken.<\/span><\/li>\n
  • Slutanv\u00e4ndare av h\u00f6grisk-AI-system<\/b> inom exempelvis medicin, finans och HR.<\/span><\/li>\n<\/ul>\n

    Dessutom p\u00e5verkas f\u00f6retag som hanterar data f\u00f6r att tr\u00e4na AI-system, med krav p\u00e5 datakvalitet och efterlevnad av GDPR.<\/span><\/p>\n

    Klassificering av AI-system i AI Act<\/b><\/h2>\n

    AI-system delas in i tre kategorier:<\/span><\/p>\n

      \n
    • H\u00f6grisk-AI-system<\/b>: Anv\u00e4nds inom kritiska sektorer som h\u00e4lso- och sjukv\u00e5rd, transport och r\u00e4ttsv\u00e4sende. Dessa system m\u00e5ste uppfylla strikta s\u00e4kerhetskrav och genomg\u00e5 kontinuerlig \u00f6vervakning.<\/span><\/li>\n
    • Begr\u00e4nsad risk<\/b>: System som kan p\u00e5verka anv\u00e4ndares r\u00e4ttigheter, exempelvis chatbots. H\u00e4r kr\u00e4vs grundl\u00e4ggande transparens, s\u00e5som att informera anv\u00e4ndaren om att de interagerar med ett AI-system.<\/span><\/li>\n
    • Minimal eller ingen risk<\/b>: AI-system med l\u00e5g p\u00e5verkan p\u00e5 s\u00e4kerhet eller r\u00e4ttigheter, exempelvis spamfilter. Dessa omfattas inte av specifika krav enligt AI Act.<\/span><\/li>\n<\/ul>\n

      CE-m\u00e4rkning och AI Act<\/b><\/h2>\n

      F\u00f6r h\u00f6grisk-AI-system \u00e4r CE-m\u00e4rkning obligatorisk, vilket visar att produkten uppfyller EU\u2019s s\u00e4kerhetskrav och f\u00e5r s\u00e4ljas inom EU. Exempel p\u00e5 h\u00f6grisk-produkter som kr\u00e4ver CE-m\u00e4rkning \u00e4r medicintekniska AI-system, s\u00e4kerhetssystem i fordon och AI-l\u00f6sningar inom utbildning och rekrytering. F\u00f6r att erh\u00e5lla CE-m\u00e4rkning m\u00e5ste dessa system genomg\u00e5 noggranna granskningar och riskanalyser.<\/span><\/p>\n

      Sammanfattning av AI-f\u00f6rordningen<\/b><\/h2>\n

      AI-f\u00f6rordningen (AI Act) b\u00f6rjar till\u00e4mpas den 1 augusti 2024 och st\u00e4ller krav p\u00e5 f\u00f6retag som utvecklar, s\u00e4ljer eller anv\u00e4nder AI-system inom EU, inklusive utl\u00e4ndska akt\u00f6rer med EU-marknaden som m\u00e5l. AI-system klassificeras utifr\u00e5n riskniv\u00e5, d\u00e4r h\u00f6grisk-AI-system kr\u00e4ver CE-m\u00e4rkning och kontinuerlig \u00f6vervakning.<\/span><\/p>\n

      AI Act p\u00e5verkar inte befintlig EU-lagstiftning som GDPR, vilket inneb\u00e4r att dataskyddskrav och r\u00e4ttigheter f\u00f6rblir of\u00f6r\u00e4ndrade f\u00f6r AI-system som hanterar personuppgifter.<\/span><\/p>\n
